Consultation
Process Agreements (CPA) - Implementation Committee
The
Consultation Process Agreements (CPA) - Implementation Committee (“Committee”)
was formed to carry out the implementation of the processes around the
new Consultation Process Agreements signed between 6 of the Treaty 8
First Nations and the province, dated December 1, 2006.
The Committee will:
-
provide advice to the Parties on the interpretation and application
of the Agreement or the Consultation Operating Guidelines
-
identify difficulties and develop solutions with the use and
application of the Consultation Operating Guidelines
-
review and approve amendments to the Consultation Operating
Guidelines in accordance with section 9.3 of the Agreements
-
attempt to resolve specific issues presented by the Parties to the
Implementation Committee
-
where possible, identify the appropriate agency or organization that
is in the best position to address issues arising between the
Parties which are outside the consultation process; and
-
coordinate the training, orientation, early implementation and
monitoring of this Agreement.
Purpose and principle functions of the Committee are to:
· Carry out those
responsibilities identified in section 8.1 of the Agreement;
· Facilitate the achievements
of the benefits that arise from this Agreement;
· Report regularly to the
Parties on the successes/challenges under the Agreement;
· Endorsed any agreed
statements, recommendations and/or reports for any submissions to the
parties;
· Where issues are identified
that fall outside the consultation process of this Agreement, the
Committee may identify the appropriate agency for organizations to
address these issues;
· The Committee may establish
working groups to address technical or other specific issues, may
proposed terms of reference and agendas, and determine meeting frequency
for such working groups;
· Oversee the definition of
the Complex Consultation Zones;
· Attend meetings and answer
correspondence in a timely manner;
· Review the bi-annual audit
of the application designations and criteria (including reviewing and
accepting the audit proposal) carried out be the Oil and Gas Commission;
and
· Approve additions to the
Consultation Operating Guidelines, such as forms, roster of
facilitators, and the First Nation referral package.
The membership of the
Implementation Committee is comprised of:
· One member of each of the
participating Treaty 8 First Nations
· Up to 6 members from the Oil
and Gas Commission and the Ministry of Energy, Mines and Petroleum
Resources; and
· Ex-officio members as
agreed. Currently there is a representative sitting on the committee
from the Canadian Association of Petroleum Producers.
The Committee endeavors to
meet monthly for the first year of the term of the Agreement, and
thereafter at least quarterly.
